如何你申请调取令了吗？(you file a petition for a writ of certiorari?)
要求法院审查下级法院上诉的人，以该特定法院要求法院审查下级法院判决所要求的格式提交一份文件。一般来说，要求调取令文件的请愿书必须包括案件各方、事实陈述、提交审查的法律问题以及法院为什么应审查判决的理由。高等法院无需审查下级法院的判决。如果高等法院决定复审该判决，它将向下级法院发出调取令。
调取令的申请必须按照申请所针对的特定法院的规则提交。这些规则因管辖权而异。例如，美国最高法院要求以小册子形式提交40份请愿书。请愿程序通常由每个司法管辖区的法规规定。
在下级法院败诉的一方撰写调取令的请愿书。请愿书必须包括案件当事人的名单。请愿书中必须包含争议事实陈述，提交给高等法院审查的法律问题应在文件中说明。败诉方应陈述其论点，解释法院为何应审查下级法院的判决。
提交给高等法院的关于为什么下级法院的决定应该被复审的论点必须给高等法院一个具体的理由，让它决定批准调取令。当下级法院在某一特定问题上存在分歧，或者下级法院的判决中存在深刻的宪法问题时，上级法院通常接受复审决定。大多数高级法院限制其审查的案件数量，因为法院没有能力回答申请审查的每个案件。
在美国，最高法院要求九名法官中至少有四名法官确定该案件有资格复审。授予调取令并不意味着法官们不同意下级法院的判决。这一裁定仅表明法院认为有理由复审下级法院的裁决。驳回调取令不会给下级法院的判决带来任何额外的法律先例。
