什么是法治？(the rule of law?)
在美国和加拿大，法治是构成司法制度基础的原则。它认为法律面前人人平等，没有人凌驾于法律之上。公民没有权利选择他们将遵守哪些法律，以及他们将忽视哪些法律。政府也受土地法律的约束。
法治是一个可以追溯到古代的概念。希腊哲学家在基督诞生前三个世纪讨论了这一概念。这一概念被认为是避免当权者滥用权力的一种方式。
当《大宪章》于公元1215年由英国约翰国王签署时，他赋予王国内所有自由人某些权利。这份文件赋予国王的臣民对错误监禁判决提出上诉的权利。《大宪章》赋予英国统治下的公民以正当程序的权利。被指控犯罪的人受当地法律管辖，必须由其同龄人判决有罪。这一概念与法治有关，并确保被指控犯有刑事罪的人得到公平对待。
没有法治原则来指导社会，暴民统治的威胁就存在。由一群人制定和执行法律，而这些人不需要平等对待每个人，这种想法不符合和平社会。在暴民统治模式下，少数群体的权利可能得不到保护，法律面前的公平也得不到实施。
根据美国、加拿大和其他国家目前实行的法治模式，政治权力较小的人与其他公民享有同样的权利。从事执法工作的人，如警察和法官，都受到与公众一样的法律约束。法律规定的平等原则保护公民不受各种理由的歧视。
美国内布拉斯加州非常重视法治。它已将“法律面前人人平等”作为其国家座右铭。这些文字包括在州印章上。
