什么是第十章？(chapter 10?)
第10章的破产形式是一个公司可以从法院系统寻求的财务保护类型之一。作为美国破产法的一部分，第十章允许有财务问题的小公司请求法院保护，同时准备一个可行的计划，以帮助公司继续经营并摆脱当前的财务负担。对于可以申请第十章保护的企业类型有一些限制，同时，为了满足法院的需要，必须遵循明确的程序。
为了有资格获得第十章的保护，公司必须向法院充分披露当前的财务状况，以供审查。在与法院合作的同时，该公司还必须愿意制定一个债务重组计划，以便有序地清偿当前的未偿债务。如果法院认为该公司符合第十章的资格，并且重组计划是可行的，法院将给予保护，并为该计划指定一名经理。法院任命的管理人将作为管辖法院和债务人公司之间的持续联络人。
需要记住的一点是，第10章的保护条款更倾向于帮助小企业，而不是大公司。为此，在第10章重组计划的支持下，可以包括的债务数额是有限制的。一般来说，累积的债务不得超过2,500,000.00美元。此外，重组计划将要求法院收到的付款时间表不超过三年的时间。如果公司欠下更多的钱，或将需要一个持续时间超过三年的重组计划，应探讨其他形式的破产。
