什么是事实问题？(a question of fact?)
事实问题是一个法律问题或案件中关于重要事实的争议。这是一个与法律问题不同的问题，法律问题需要运用法律原则来解决。如果存在事实问题，法官或陪审团（也称为事实审判员）将被要求解决手头的问题。
争议是事实问题还是法律问题可能会让人有些困惑。通常，事实问题的大多数例子都会问一个事件或行动是否发生以及如何发生，而法律问题则会问一个事件或行动是否合法。例如，一个法律问题可能会问，被告乔枪杀他的妻子是预谋谋杀还是激情犯罪。相比之下，一个事实问题是，被告乔是否枪杀了他的妻子。
虽然这些类别可能会变得有些模糊，但确定某件事是法律问题还是事实问题，对案件是否进入审判或是否服从即决判决起着重要作用。如果一个案件的事实问题没有争议，而且该案件显然只包含一个法律问题，法官可以选择对该案件进行简易裁决，而不是下令审判。例如，如果一名被控超速的人得到了一张罚单，但他和开罚单的官员都同意他只是在自己的财产上超速，那么超速法是否适用于个人所有的财产可能会被视为一个法律问题。根据适用的交通法，法官可能会说超速法是否适用于本案，从而对该问题做出简要判断。。
决定案件是否继续审理的一个关键是事实问题对案件是否重要。如果争议事实涉及与案件无关的琐碎事项，法官可以决定发布简易判决，忽略事实问题。如果对一件不动产的欺诈性出售提起诉讼，原告和被告的唯一真实的争执是在出售当天在电视上进行的足球比赛，法官不得考虑与审判有关的事实问题。
以事实问题为中心的案件通常很难上诉。由于在基于事实的审判中，法官可以获得所有证据，上诉法院通常认为他或她能够就某件事是否属实做出明确的决定。相比之下，在处理法律问题时，上诉法院更有可能愿意听取声称原法官或陪审团没有正确解释或适用法律的上诉。
