什么是商议？(a deliberation?)
审议是指陪审团或法官小组成员讨论案件事实并达成决定的私人会议。审议是为了确定有罪或无罪，也可能在人们酝酿判刑决定时使用。审议过程是许多法律制度的一个重要组成部分，为听取了案件事实的人们提供了一个仔细权衡的机会，并得出一个基于逻辑和理性的决定。
评议的典型例子是陪审团评议。一旦案件结束，陪审员被护送到一个私人房间，在那里他们讨论案件，并就判决是有罪还是无罪进行投票。陪审员审议时可能会进行多次投票，通常鼓励陪审员尝试达成一致的结果，而不是出现所谓的 "悬空陪审团"，即陪审员无法就裁决达成一致。
在陪审员进入房间进行审议之前，法官会做出一系列指示。法官解释了证据标准，并讨论了可能返回的各种裁决。陪审员可以要求获得一份指示的副本，或要求重复指示，当指示较长或复杂时，通常建议这样做。
在审议过程中，一名陪审员被选为陪审团主席，她或他通常监督审议过程，包括计票和指导讨论。一旦达成裁决，陪审团主席就会提醒等待的法警，然后陪审团被护送回法庭宣读裁决书。在某些情况下，审议可能只持续几分钟，而在其他情况下，审议可能会持续数天。有时，法官会命令陪审团在此期间进行隔离，这意味着他们不能与其他人互动，并被隔离起来，直到他们就裁决达成一致。当担心陪审员可能受到法庭外人员的影响时，就会下令隔离。
陪审员在审议期间不允许胁迫、强迫或威胁对方。虽然在陪审员房间里有时会出现紧张气氛，但必须遵守道德标准，以确保裁决的有效性。如果陪审员感到被迫做出决定，这可能成为日后提出法律质疑的理由，因此法院希望谨慎地避免在陪审团室中出现任何不当行为。
